Throughout this document, “Company,” “we,” “our,” or “us” refers to SITEMAKERT LLC and its affiliated platforms.

1. ACCEPTANCE OF TERMS

By accessing our websites, downloading our mobile app, registering an account, posting listings, purchasing services, or conducting transactions, you agree to be legally bound by these Terms.

If you do not agree, you must discontinue use immediately.


2. NATURE OF OUR SERVICES

A. Digital & Business Services (SITEMAKERT)

We provide:

Website development

Domain and hosting assistance

Email and Microsoft 365 setup

SSL configuration

Business consulting

Intermediation services


B. Marketplace Services (KOMINOTEM)

Kominotem is a community marketplace allowing users to:

Buy and sell products

Offer services

Post job opportunities

Promote events

Communicate via secure messaging

Build verified profiles


Kominotem is a technology platform only.

We are NOT:

A retailer

A wholesaler

A manufacturer

An employer

A recruitment agency

A delivery company

A financial institution


3. PAYMENT PROCESSING (STRIPE & THIRD-PARTY PROCESSORS)

A. Stripe Processing

Where payment functionality is enabled:

Payments are processed via Stripe, a third-party payment processor.

Buyers submit payment securely through Stripe’s infrastructure.

Funds are processed for the benefit of the merchant.


SITEMAKERT LLC:

Does not store full credit card information.

Does not act as the seller of goods unless explicitly stated.

Acts as a technology facilitator.


Stripe’s terms and policies also apply to transactions.


B. Merchant of Record Clarification

Unless explicitly stated otherwise:

The merchant/seller is the Merchant of Record.

The merchant is responsible for taxes, fulfillment, refunds, and compliance.


SITEMAKERT LLC does not assume seller liability.


4. OVERSEAS & CROSS-BORDER PAYMENTS

For international transactions, we may utilize third-party financial platforms, including but not limited to:

Stripe

Regional payment processors

Licensed remittance partners

Mobile payment systems


For cross-border payments:

Currency conversion may apply.

Exchange rate differences are determined by the payment processor.

Additional transaction fees may apply.

Regulatory compliance requirements may apply based on jurisdiction.


SITEMAKERT LLC:

Is not responsible for currency fluctuations.

Is not liable for international transfer delays.

Is not responsible for foreign banking restrictions.

Does not guarantee availability of payment methods in all countries.


Users agree that overseas payments are subject to the policies of the third-party financial service used.


5. CHARGEBACKS & DISPUTES

In the event of:

Payment disputes

Chargebacks

Fraud claims

Reversals


Stripe or the applicable payment provider will manage the dispute process.

Merchants are responsible for:

Responding to disputes

Providing proof of delivery

Covering chargeback fees


SITEMAKERT LLC is not liable for:

Financial losses due to disputes

Fraudulent purchases

Chargeback penalties


We reserve the right to suspend merchants with excessive disputes.


6. USER RESPONSIBILITY

Users agree to:

Provide accurate information

Maintain account security

Comply with local laws

Conduct safe transactions


Users are fully responsible for their listings, services, and agreements.


7. PROHIBITED ACTIVITIES

Users may not:

Sell illegal goods

Post stolen items

Conduct scams

Post fraudulent job offers

Manipulate transactions

Launder money

Use the platform for unlawful activity


Violations may result in permanent suspension and legal reporting.


8. NO GUARANTEE OF RESULTS

We do not guarantee:

Sales

Revenue

Business growth

Job placement

Event attendance

Financial profit


Marketplace performance depends on market conditions and user effort.


9. INTELLECTUAL PROPERTY

Digital Services:

Upon full payment, clients own their custom website content.

SITEMAKERT LLC retains ownership of:

Platform architecture

Software systems

Templates

Branding

App infrastructure


Marketplace users retain content ownership but grant us a license to display and promote listings.


10. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

SITEMAKERT LLC shall not be liable for:

Indirect damages

Lost profits

Business interruption

Data loss

User misconduct

Payment processor failures

Cross-border banking issues


Total liability shall not exceed the amount paid to us for the service in question.


11. SAFETY DISCLAIMER

Users agree to:

Meet in public locations

Verify identities

Use secure payment methods

Exercise independent judgment


We encourage safe practices but cannot guarantee safety.


12. MOBILE APPLICATION LICENSE

The Kominotem app is licensed, not sold.

You may not:

Reverse engineer

Modify

Resell

Copy


Google Play is not responsible for app support or disputes.


13. TERMINATION RIGHTS

We may:

Suspend accounts

Remove listings

Terminate services

Block transactions


At our sole discretion.


14. REGULATORY COMPLIANCE

Users agree to comply with:

Anti-money laundering laws

Tax regulations

Consumer protection laws

Local commerce laws


SITEMAKERT LLC may cooperate with regulatory authorities when required.


15. GOVERNING LAW

These Terms are governed by the laws of:

The United States and the State of Massachusetts.


16. MODIFICATIONS

We may update these Terms at any time.

Continued use constitutes acceptance of revisions.
